1. Introduction

Welcome to our online ordering platform (“Service”). The Service is provided jointly by:

• Grub Direct (the “Platform Provider”), located at 5 South Charlotte Street, Edinburgh, Scotland, EH2 4AN, email [email protected].

Throughout this document, “we,” “us,” or “our” refers collectively to both Saffron Restaurant Waterloo and Grub Direct, except where a specific responsibility is clearly attributed to one party (e.g., food preparation). By accessing or using our Service, you agree to the following Terms & Conditions and the Privacy & Cookie Policy (collectively, the “Agreement”). If you do not agree with any part of this Agreement, please discontinue use of the Service.

2. Terms & Conditions

2.1 Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Service.
• If you are under 18, a parent or legal guardian must consent to your use of the Service.

2.2 Relationship of Parties

1. Saffron Restaurant Waterloo (Restaurant)

• Responsible for creating and updating the menu, preparing and fulfilling orders, and managing any customer service issues, refunds, or delivery (or pickup) of ordered items.
• Solely liable for the quality, safety, and preparation of all food and beverages offered.

2. Grub Direct (Platform Provider)

• Provides the technology infrastructure for online ordering, payment processing integrations, and related services.
• Not responsible for food preparation or the quality/safety of any items ordered.
• Not a party to the transaction between you and Saffron Restaurant Waterloo except in providing technical and administrative support.

2.3 Account Registration

Accuracy of Information

• You may need to create an account or provide certain information (e.g., name, address, email, payment details) to place orders. You agree to provide accurate and up-to-date information.

Account Security

• You are responsible for safeguarding your account credentials and for all activities or actions that occur under your account.
• Notify us immediately if you suspect unauthorized use of your account or any breach of security.

Suspension or Termination

• We reserve the right to suspend or terminate your account if we believe you have violated these Terms, engaged in fraudulent activity, or otherwise misused the Service.

2.4 Orders & Payments

Order Placement

• By placing an order, you agree to pay all applicable fees (including taxes, delivery charges, and other surcharges) shown at checkout.
• An order confirmation (email, SMS, or on-screen) acknowledges receipt of your request but does not guarantee acceptance. We may decline orders for any reason, including unavailability.

Pricing & Availability

• All menu items, prices, and availability are subject to change without notice.
• While we strive for accuracy, occasional errors may occur in pricing or item details.

Payment Processing

• Payments are processed through third-party payment providers integrated by Grub Direct. We do not store full payment card details on our servers.
• By submitting your payment information, you authorize us (and our payment processors) to charge your selected payment method.

Cancellations & Refunds

• If you wish to cancel or modify an order, contact Saffron Restaurant Waterloo immediately. Once food preparation has started or the order has shipped (for delivery), we may be unable to accommodate changes.
• Refunds or credits are issued at Saffron Restaurant Waterloo’s discretion, in accordance with applicable laws and our internal policies.

2.5 Delivery or Collection

Delivery Services

• If offered, Saffron Restaurant Waterloo or its designated courier will handle deliveries. Delivery times are estimates only and can be affected by traffic, weather, or other factors.

Collection/Pickup

• If you choose pickup, please verify the operating hours and address for Saffron Restaurant Waterloo (92 St John’s Rd, Waterloo, Liverpool L22 9QQ)

Failed or Incorrect Delivery

• It is your responsibility to provide an accurate delivery address. We are not liable for orders delivered to an incorrect address due to user error.

2.6 User Conduct

By using our Service, you agree NOT to:

• Violate any applicable laws or regulations.
• Post or transmit false, misleading, defamatory, or infringing content.
• Engage in fraudulent activities or misuse the Service.
• Disrupt or interfere with the Service’s functionality or security (e.g., introducing viruses or other harmful code).

Food & Product Liability

• Saffron Restaurant Waterloo is solely responsible for the preparation and quality of all menu items.
• Grub Direct assumes no liability for the food or related services provided by Saffron Restaurant Waterloo.

No Warranties

• Except as required by law, the Service is provided “as is” without any warranty, express or implied, including warranties of merchantability or fitness for a particular purpose.

2.9 Limitation of Liability

• To the fullest extent permitted by law, neither we (Saffron Restaurant Waterloo and Grub Direct) nor our officers, employees, or affiliates shall be liable for indirect, incidental, or consequential damages arising out of or related to your use of the Service.
• In any event, our total liability for direct damages shall not exceed the amount you paid for the specific order from which the claim arose.

2.10 Indemnification

You agree to indemnify and hold harmless Saffron Restaurant Waterloo, Grub Direct, and their respective officers, employees, and affiliates from any claims, liabilities, damages, or expenses arising out of or related to your misuse of the Service or violation of these Terms.

2.11 Changes to These Terms

We may update or modify these Terms by posting a revised version with a new “Last Updated” date. Your continued use of the Service after any such changes indicates your acceptance of the modified Terms.

2.12 Governing Law and Jurisdiction

These Terms are governed by the laws of Scotland, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the Scottish courts.
